1. General Eligibility
1.1. Certain charges under the Policy on Non-Academic Misconduct are set fine eligible. This means that if the student admits responsibility for the offence they can pay a set fine (and restitution if applicable) without going to a hearing.
1.2. The set fine option is not available if a student is on non-academic probation, residence probation, evicted from residence, or if a hearing is recommended by the investigating officer.
1.3. In addition to paying the set fine, the student will be placed on Non-academic Probation for two semesters.
1.4. The following are breaches that are eligible for Notices of Offence and the section reference under the Policy:

2.1. $65 - Failure to abide by the University’s use of In-Line Skates, Roller Skates, Skateboards and Hoverboards Policy (section 4.2.)
2.2. $150 - Did urinate in a public place (section 4.2.) (By-law)
2.3. $120 - Did dispose of broken glass in a public area (section 4.2.) (By-law)
2.4. $120 - Violation of section 4.2.3. Cannabis
2.5. $120 - Violation of section 4.2.2. Alcohol
2.6. $120 - Violation of section 4.2.4. Smoking
2.7. $100 - Violation of section 4.2.6. Permits and Identification
2.8. $100 - Violation of section 4.3.1. Access to University Property
2.9. $100 + Restitution - Did unlawfully access/remove/possess University and/or personal property under $200.00 (section 4.3.2.)
2.10. $200 + Restitution - Did unlawfully access/remove/possess University and/or personal property over $200.00 (section 4.3.2.)
2.11. $100 + Restitution - Mischief/Damage under $200.00 (section 4.3.2.)
2.12. $200 + Restitution - Mischief/Damage over $200.00 (section 4.3.2.)
2.13. $75 - Fail to be responsible for guest (section 4.4.5.)
2.14. $120 - Violation of section 4.4. Safety relating to failure to adhere to COVID-19 prevention protocols and guidelines
3. Process
3.1. For offences that occurred outside of residence, Student Judicial Services will normally email you within seven (7) business days of you receiving your Notice of Offence. In that email, Student Judicial Services will let you know if your offence is set fine eligible. If your offence is set fine eligible, you must contact Student Judicial Services at judicial@uoguelph.ca [2] within seven (7) business days to enter a response. If you do not enter a response during this time, “Responsible” will be automatically entered and an invoice for the fine will be sent to you for payment.
3.2. Response Options
3.2.1. Responsible - Students admit that they are responsible for the alleged breach of the Policy on Non-Academic Misconduct.
If the offence is set fine eligible (based on the offence and the general eligibility criteria) then entering a plea of responsible means that the student will be invoiced for the amount of the set fine and restitution (if applicable). The student will also automatically be placed on non-academic probation for the present and next registered semester. The student will not be required to attend a hearing.
3.2.2. Responsible with Explanation - Students admit that they are responsible for the alleged breach of the Policy on Non-Academic Misconduct, but there are specific and extenuating circumstances that they want to bring to the attention of the Judicial Committee.
By pleading responsible with explanation, a hearing will be set before the Judicial Committee. At the hearing you will have the ability to present an explanation or any specific and extenuating circumstances. This does not necessarily result in a lesser fine but rather is an opportunity for you to tell your story and present any factors you wish the Committee to consider. The Judicial Committee will determine the outcome.
3.2.3. Not Responsible - Students do not admit responsibility for the alleged breach of the Policy on Non-Academic Misconduct.
By pleading not responsible, a hearing will be set before the Judicial Committee. If you demonstrate to the Committee that the charge is unwarranted, the charge will be disposed of. Otherwise, the Judicial Committee will determine the outcome.
